Increased Prosecutions by FDA Division

There are plans to increase prosecutions against Food and Drug industry executives by the Pharmaceutical and Food Administration. This has come about as an attempt to change the focus of their criminal division.

According to an FDA official, the administration has the ability to prosecute the executives for criminal activities or actions that may be taking place in their company. The provision that allows this is called “strict liability” and has rarely been used in the past few years. This provision means the government does not have to “show intent to defraud in order to get a conviction”.
